CNN —The Supreme Court on Monday turned away Tesla CEO Elon Musk’s request to back out of a settlement agreement he struck with the Securities and Exchange Commission in 2018 over a series of tweets about the car maker that regulators alleged were fraudulent. To avoid enforcement, Musk agreed to a settlement that required him to have a company lawyer approve his social media posts about Tesla. Though he agreed to the “Twitter sitter” provision, Musk has subsequently challenged it as a violation of his First Amendment rights. The Supreme Court rejected Musk’s appeal without comment and there were no noted dissents. A US District Court and the 2nd US Circuit Court of Appeals rejected Musk’s request to declare the Twitter sitter provision unenforceable.

New York CNN —Federal safety regulators said they are investigating whether Tesla’s massive recall in December of essentially all of its vehicles on US roads was sufficient to fix the safety threat posed by its “Autopilot” feature. The recall of 2 million Tesla vehicles was ordered by the National Highway Traffic Safety Administration over a software update that is designed to limit the use of its Autopilot feature. The NHTSA said late Thursday that Tesla’s software update recall requires the owner to opt in and allows a driver to readily reverse it. The software update ordered in December was designed to give Tesla drivers more warnings when they are not paying attention to the road while using the Autopilot’s “Autosteer” function. After the recall, Tesla vehicles with Autosteer turned on were supposed to check on the driver’s attention level more routinely.

The companies are asking federal courts, often with conservative, pro-business judges, to stop the agency from standing behind the more activist unions now making their lives more difficult. “The NLRB has long used the federal courts … to obtain injunctions … before the merits of an unfair labor practice case are fully evaluated,” said a statement from Starbucks. The employer doesn’t have to pay any interest, penalty or fine, to the fired workers, their union or the agency. While this is the first such case to reach the Supreme Court, other cases are emerging in which some high profile employers are challenging the agency’s right to exist. Tesla tries again on Musk’s record pay packageNearly three months ago, a Delaware court voided Elon Musk’s multibillion-dollar pay package that Tesla’s board — and most shareholders — had given him in 2018, contending that the process to decide it was “deeply flawed” and that the company didn’t properly disclose it to investors. On Wednesday, Tesla said that it would ask shareholders to vote again on that same pay package, now valued at about $47 billion, at its annual meeting on June 13. HALO SpaceLast week in London, HALO Space CEO Carlos Mira unveiled the interior design for its Aurora space capsule, which his team hopes will transport 10,000 passengers to near-space by 2030. Within a very limited space, comfortable seating, generous viewing windows, storage areas and, most importantly, a toilet cubicle all had to be integrated. CNN —A federal judge on Monday threw out a lawsuit by Elon Musk’s X that had targeted a watchdog group for its critical reports about hate speech on the social media platform. In a blistering 52-page order, the judge blasted X’s case as plainly punitive rather than about protecting the platform’s security and legal rights. X has blamed CCDH’s reports, which showcase the prevalence of hate speech on the platform, for amplifying brand safety concerns and driving advertisers away from the site. In the suit, X claimed that it had suffered tens of millions of dollars in damages from CCDH’s publications. “If CCDH’s publications were defamatory, that would be one thing, but X Corp. has carefully avoided saying that they are,” Breyer wrote.

In Taiwan, the government is racing to do what no country or even company has been able to: build an alternative to Starlink, the satellite internet service operated by Elon Musk’s rocket company, SpaceX. Starlink has allowed militaries, power plants and medical workers to maintain crucial online connections when primary infrastructure has failed in emergencies, such as an earthquake in Tonga and Russia’s invasion of Ukraine. Officials in Taiwan face constant reminders that its communication infrastructure must be able to withstand a crisis. The island democracy sits 80 miles from China, where leaders have vowed to use force if needed to assert claims that Taiwan is part of its territory. Taiwan experiences regular cyberattacks and near-daily incursions into its waters and airspace by the People’s Liberation Army, which has been built up in recent years.

Regulators at the European Commission say they’re particularly concerned about how generative AI could sow chaos in the run-up to this summer’s EU parliamentary elections. Online platforms will have until April 5 to respond to questions about steps they’ve taken to prevent AI tools from spreading election misinformation. The companies’ responses could be incorporated into a series of election security guidelines for tech platforms the European Commission plans to finalize by March 27, another commission official said. The AI investigation also covers a broader set of topics including how platforms are addressing generative AI’s impact on user privacy, intellectual property, civil rights and children’s safety and mental health. “One of the grievances we have is the ability to manipulate the service through automated means and this can include generative AI, so yes, there’s a link to the ongoing investigation,” one of the commission officials said.
